PART I – PRIVACY POLICY (GDPR)

PART II – GENERAL TERMS AND CONDITIONS OF SALE AND RENTAL
11. Product Purpose – Professional Use Only
All ATB Creation products are intended exclusively for professional decorative use in areas not directly accessible to the public, such as shop windows, stages, podiums or themed displays.
👉 These products are not toys.
Sales and rentals are limited to professionals holding a valid business registration number (SIREN or equivalent).
12. Conditions of Use
Each product must be used strictly in accordance with its intended purpose and instructions.
The customer undertakes to:
- Not modify the product without prior written authorization
- Not remove any markings (brand, serial number, technical data)
- Prevent public access to the products
ATB Creation cannot be held liable for improper use.
13. Descriptions and Images
All photos, descriptions and specifications are non-contractual.
ATB Creation reserves the right to modify dimensions, colors, materials or components without prior notice for improvement or regulatory reasons.
14. Orders
Any order becomes final upon:
- Signature of the order form
- Payment of a 40% deposit
Documents related to standards and classifications must be requested at the time of ordering.
15. Delivery and Transport
Delivery dates are provided for information only.
Goods travel at the customer’s own risk.
Any claims must be made within 48 hours of receipt.
16. Payment Terms
- 40% deposit upon order confirmation
- Balance payable before shipment
Any cancellation initiated by the customer results in forfeiture of the deposit as compensation.
17. Late Payment
Any late payment will result in:
- Late penalties at the legal rate increased by 50%
- Suspension or cancellation of deliveries without prior notice
18. Retention of Title
All products remain the full property of ATB Creation until full payment has been received
(French law n°80-335 of May 12, 1980).
19. Warranty – Sale
All automates are covered by a 1-year parts and labor warranty, excluding transport.
Any repair carried out outside ATB Creation workshops voids the warranty.
20. Resale
Resale is prohibited until full payment has been made.
After full payment, resale is permitted subject to compliance with applicable standards and electrical compatibility.
PART III – SPECIFIC RENTAL CONDITIONS
21. Rental Period
Standard rental duration is seven (7) consecutive weeks starting from the date of receipt.
Any additional week started will be invoiced according to the current price list.
22. Use and Liability
From the date of receipt, the renter is fully responsible for:
- The rented product
- Any damage to the product
- Any damage caused to persons or surrounding property
The renter must take out appropriate insurance covering all associated risks.
23. Failure and Replacement
In the event of a product failure during the rental period, ATB Creation may offer:
- A partial or full refund of the rental fee
- Or a replacement product, subject to availability
👉 ATB Creation is under no obligation to intervene on site.
24. International Rental
Rental outside mainland France is possible upon request.
Specific conditions may apply depending on the destination country.
25. Applicable Law and Jurisdiction
These terms are governed by French law.
👉 The Commercial Court of Évreux shall have exclusive jurisdiction in the event of any dispute.
